Conditions of the AtosTour Foundation

As a participant or supervisor of the AtosTour you automatically agree to these terms and conditions.

    1. Definitions

      1. AtosTour
        A 2-day cycling tour organised by AtosTour foundation from Paris to Eindhoven, covering a distance of max 500 km.
      2. AtosTour Committee
        The organising committee of the AtosTour, holding the right to organize the AtosTour, with whom a cyclist or facilitator has entered into an agreement to participate in the AtosTour.
      3. Cyclist
        A participating Cyclist is either an Atos employee or retired Atos employee or the partner of a (retired) Atos employee or, to a limited extent, a relation (client, supplier or friend) of Atos, who has registered for participation and has received, from the AtosTour Committee, written confirmation of participation.
      4. Facilitator
        A participating Facilitator assists, upon appointment by the AtosTour Committee, the organisation of the AtosTour prior to, during and after the AtosTour in the role of supplier, driver, cashier, motard, general medical practitioner, first-aid medic, mechanic, photographer, welcome team, and/or any other role assigned by the AtosTour Committee.
      5. Team AtosTour
        The Team AtosTour consists of the AtosTour Committee and the Facilitators.
      6. Agreement
        The combination of the written confirmation of participation, these General Terms & Conditions and the communication of the content of the AtosTour Package.
      7. AtosTour Package
        The package of services and goods to which the Cyclist and Facilitator are entitled in relation to the AtosTour.
    2.  Participation

      1. A Cyclist or Facilitator can participate to the AtosTour when he/she has truthfully and correctly completed the registration form, has timely paid the registration fee, has agreed to the General Terms & Conditions and has received written confirmation of participation.
      2. In case of cancellation of participation by a Cyclist or Facilitator the registration fee will be reimbursed upon the following conditions:
        At cancellation ultimately 2 full calendar months before the AtosTour (i.e. before 1st July), the full registration fee will be reimbursed to the former participant. Thereafter, no reimbursement will take place.
      3. The AtosTour Committee has discretionary authority to cancel the AtosTour in case of extraordinary circumstances.
      4. In case the AtosTour Committee decides to use the discretionary authority as described in article 2.3, the AtosTour will not be liable to reimburse any registration fees to Cyclists nor Facilitators.
      5. The AtosTour is not a cycling competition nor Gran Fondo but an endurance tour with a social purpose.
      6. Cyclists and Facilitators must abide to traffic laws and regulations of the countries that are visited by the AtosTour.
      7. Cyclists and Facilitators are responsible for their own safety and must respect the safety and integrity of other people on the road and of nature and the environment that they cross.
      8. Cyclists declare that they have trained sufficiently, have prepared themselves and their bicycles and that Cyclists and their bicycles are in good condition to cycle the AtosTour in 2 days.
      9. Participation to the AtosTour is always at the Cyclist’s or Facilitator’s own risk.
      10. It is mandatory to wear a protecting helmet during cycling.
      11. Cyclists and Facilitators use proper front and rear lights when indicated by the Team AtosTour. Cyclists must have proper front and rear lights installed on their bicycles.
      12. Cyclists must follow instructions given by the Team AtosTour.
      13. The AtosTour Committee reserves the right to exclude a Cyclist from participation with immediate effect when, after being instructed or warned by the Team AtosTour, the Cyclist does not follow instructions of the Team AtosTour or does not abide to traffic laws and regulations or these General Terms & Conditions.
      14. Cyclists and Facilitators agree with the use of their picture(s) in print, photo, film, video, social media, etc. for promotion purposes of the AtosTour and the associated charities, without any entitlement to payment or compensation.
      15. The AtosTour Committee has full right of use of photo’s, films and videos that have been produced in relation to the AtosTour. In case of publication the AtosTour Committee will endeavour to mention source and/or author.
      16. Each Cyclist and each member of Team AtosTour is entitled to use of the AtosTour Package. The content of the AtosTour Package is communicated to each Cyclist and each member of Team AtosTour as part of the Agreement.
      17. Cyclists and Facilitators are aware of and agree with the social purpose of the AtosTour, in particular the purpose to raise funds for local (national) organisations that fight cancer or support its victims and are selected as charities by the AtosTour Committee.
      18. When a Cyclist and/or Facilitator come from a country where the AtosTour Committee has not yet selected a cancer charity, Cyclist and/or Facilitator and the AtosTour Committee will together select a national cancer charity from whom the Cyclist and/or Facilitator will solicit relevant information and with whom the Cyclist and/or facilitator will keep contact for the social purpose of the AtosTour.
    3. Responsabilities & Liabilities

      1. Participation to the AtosTour is always at the Cyclist’s or Facilitator’s own risk. The AtosTour Committee is not responsible nor liable for loss, theft or damage to property of Cyclists and members of Team AtosTour that follows from participation to the AtosTour. The AtosTour Committee is also not responsible nor liable for injury, sickness, disability or death of Cyclists and members of Team AtosTour that follows from participation to the AtosTour.
      2. Cyclists and members of Team AtosTour should, when they deem necessary, insure themselves against loss, theft or damage to property and against injury, sickness, disability or death in relation to participation to the AtosTour.
      3. Members of Team AtosTour can’t be held responsible nor liable for loss, theft or damage to property of Cyclists and members of Team AtosTour nor for injury, sickness, disability or death of Cyclists and members of Team AtosTour in relation to participation to the AtosTour.
      4. Cyclists and members of Team AtosTour participate in traffic at their own risk and the AtosTour Committee is not responsible nor liable for damage, injury, sickness, disability or death following an accident on the road.
      5. The Cyclist or the member of Team AtosTour is solely responsible and liable for damage, injury, sickness, disability or death he/she inflicts upon him/herself or upon a third person.
      6. The Cyclist or the member of Team AtosTour indemnifies the AtosTour Committee for damage that a third person may suffer as a result of action or lack of action by the Cyclist or the member of Team AtosTour. The Cyclist or the member of Team AtosTour should arrange sufficient insurance against third party liability.
      7. The AtosTour Committee is not responsible nor liable for cost incurred by the Cyclist or the member of Team AtosTour in case the AtosTour is cancelled.
      8. The AtosTour Committee is not responsible nor liable for cost incurred by the Cyclist or the member of Team AtosTour in case he/she is excluded from participation during the AtosTour.
      9. The AtosTour Committee is not responsible nor liable for direct nor indirect damages of third parties that are caused by Cyclists or members of Team AtosTour.
